Axton Enterprises Service Agreement

This agreement outlines the basic terms for website, automation, e-commerce, and related digital services provided by Axton Enterprises. By continuing, the client agrees to the selected setup fee, monthly service fee, project scope, and terms below.

1. Selected Plan and Payment

The client agrees to pay the one-time setup fee and recurring monthly service fee associated with the selected plan. Monthly service fees cover hosting, maintenance, support, and included services listed for the selected plan. Third-party costs, including payment processor fees, domain fees, premium software, Google Workspace, Microsoft 365, Stripe, Square, plugins, subscriptions, or other vendor charges, may be billed separately unless specifically stated as included.

2. Initial Consultation and Revisions

The setup fee includes one initial consultation and up to two rounds of revisions before launch. A revision round means a consolidated set of reasonable requested changes to the agreed project scope. Additional revisions, major redesigns, new features, or changes outside the original scope may require additional fees.

3. Client Responsibilities

  • The client is responsible for providing accurate business information, branding assets, images, text, product details, login access, and approvals needed to complete the project.
  • The client confirms they have the rights to use any content, images, logos, trademarks, or materials they provide.
  • Project timelines may be delayed if requested information, access, or approvals are not provided in a timely manner.

4. Scope of Work

Axton Enterprises will provide the services listed under the selected plan. Work outside the selected plan, including additional pages, custom integrations, advanced automations, product uploads, copywriting, logo design, photography, legal copy, privacy policies, terms of service, or complex database work, may require a separate quote.

5. Launch, Maintenance, and Monthly Service

After launch, the monthly fee covers ongoing hosting, basic maintenance, and support according to the selected plan. Canceling monthly service may result in loss of hosting, maintenance, support, analytics access, or other managed services provided by Axton Enterprises.

6. Payments, Refunds, and Cancellations

Setup fees reserve project time and begin the onboarding process. Setup fees are generally non-refundable once work has started. Monthly services may be canceled prospectively, but past monthly charges are not refunded. Any unpaid balances must be resolved before final files, transfers, or additional work are completed.

7. Ownership and Access

Upon full payment, the client owns the final custom website content and design created specifically for the client, excluding third-party tools, licensed software, stock assets, templates, plugins, proprietary systems, or reusable code owned by Axton Enterprises. Axton Enterprises may retain portfolio rights to display completed work unless the client requests otherwise in writing.

8. Limitation of Liability

Axton Enterprises is not responsible for lost revenue, lost data, service interruptions, third-party platform outages, payment processor issues, search ranking changes, account suspensions, or indirect damages. Services are provided in good faith to improve online presence and business functionality, but specific sales, ranking, traffic, or revenue results are not guaranteed.

9. Agreement Acceptance

By checking the agreement box and continuing, the client confirms they have reviewed and accepted these terms and authorize Axton Enterprises to begin the onboarding and checkout process for the selected plan.
